The Model WHS Laws

What are they:

In an effort to harmonise WHS laws across the country and end disparities and inconsistencies faced by businesses operating across jurisdictions, the Model WHS Laws (Act, Regulations and Codes of Practice) were developed.

The model laws have been implemented in all jurisdictions, except VIC with WA expected to incorporate the model laws by mid-2021.

The model laws aim to ensure directors and other key decision makers not only fully understand WHS risks in their organisation, but also take positive steps to manage these risks and create a positive safety, risk and emergency management culture.

Your Obligations:

Regulation 43 of the WHS law places the primary duty of care on the Person conducting a business or undertaking (PCBU) in all jurisdictions to;

  • have a detailed and specific emergency plan for the workplace
  • ensure the described process and procedure is embedded within the workplace
  • implement the emergency plan(s) in any emergency.
